By accessing or using our website, purchasing any product, or engaging in any counselling service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our services. β οΈ IMPORTANT: These Terms constitute a legally binding agreement between you ("User", "Client", "you") and CommfyCouch ("we", "us", "our"). By using our services, you confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement. 1. Definitions In these Terms, the following definitions apply: "CommfyCouch" / "Platform": Refers to the website www.commfycouch.com, its subdomains, mobile-compatible version, and all services offered thereunder. "Services": Refers collectively to (a) online psychological counselling sessions, (b) sale of digital journal products, (c) wellness content and resources published on the platform. "Counselling Services": Refers to one-to-one or group online counselling sessions conducted by qualified counselling professionals affiliated with CommfyCouch. "User" / "Client": Any person who accesses or uses the CommfyCouch platform, whether or not they make a purchase. "Content": All text, images, graphics, audio, video, journal designs, blog posts, social media materials, and other intellectual property published by CommfyCouch. 2. Acceptance of Terms By accessing www.commfycouch.com, purchasing a digital product, booking a counselling session, or otherwise using any CommfyCouch service, you: β Confirm that you have read, understood, and agree to these Terms and our Privacy Policy β Confirm that you are 18 years of age or older β Confirm that you have the legal authority to enter into this agreement β Agree to use CommfyCouch's services only for lawful purposes We reserve the right to update or modify these Terms at any time. Continued use of the platform following any changes constitutes acceptance of the revised Terms. It is your responsibility to check for updates. 3. Description of Services 3.1 Online Counselling Sessions CommfyCouch offers psychological counselling and wellness support services conducted by trained professionals. Our services include individual counselling sessions, psycho-educational support, and wellness guidance. Our services do NOT constitute medical advice, psychiatric diagnosis, or clinical psychological treatment. We are not a substitute for emergency mental health services, psychiatric care, or in-patient treatment. If you are experiencing a psychiatric emergency, please contact emergency services immediately or visit the nearest hospital. Our counsellors hold relevant educational qualifications in psychology and counselling. 3.3 Wellness Content CommfyCouch publishes educational and informational content on psychology, mental health, self-improvement, and wellness. This content is for general informational and educational purposes only and should not be relied upon as professional psychological advice. 3.4 Service Availability We strive to maintain uninterrupted service availability but do not guarantee that the platform will be available at all times. Scheduled maintenance, technical issues, or circumstances beyond our control may result in temporary unavailability. CommfyCouch shall not be liable for any loss arising from service unavailability. 4. User Accounts and Registration To access certain features of CommfyCouch (such as purchasing products or booking sessions), you may be required to create an account. By creating an account, you agree to: β Provide accurate, current, and complete information during registration β Maintain and promptly update your account information to keep it accurate and current β Keep your account password confidential and not share it with any third party β Notify us immediately at support@commfycouch.com of any unauthorised access to or use of your account β Accept responsibility for all activities that occur under your account CommfyCouch reserves the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity. 5. Counselling Session Booking and Conduct 5.1 Booking Process Counselling sessions may be booked through the CommfyCouch website. A booking is confirmed only upon receipt of full payment. You will receive a confirmation email with session details and access link within 24 hours of booking. 5.2 Session Format Sessions are conducted online via video conferencing or voice call, as agreed between you and your counsellor. Sessions are typically 45β60 minutes in duration unless otherwise specified. You are responsible for ensuring a stable internet connection and a private, comfortable space for your session. After completion of the first sessionβs 60 minutes time period a fee for a full session will be charged upto for the next 45 minutes. 5.3 Cancellation Policy β Strict No-Refund β οΈ ALL session fees are strictly non-refundable under any and all circumstances. No refund shall be issued regardless of who cancels, when the cancellation occurs, or the reason for cancellation. CommfyCouch operates a strict no-refund policy on all counselling sessions. The following terms apply: β Sessions cancelled by the Client (at any time, for any reason): No refund will be issued under any circumstances. No rescheduling is guaranteed; any rescheduling is purely at CommfyCouch's discretion as a goodwill gesture. CommfyCouch β Terms & Conditions | www.commfycouch.com | Page 2 β Sessions cancelled by CommfyCouch (at any time, for any reason): CommfyCouch reserves the absolute right to cancel or reschedule any session at any moment without prior notice and without any liability or obligation to refund. No refund shall be due in such cases; CommfyCouch may, at its sole discretion, offer a rescheduled slot as a goodwill gesture only. β No-shows (Client fails to attend without prior notice): The session fee is forfeited entirely. No refund, credit, or rescheduling will be offered. β Technical failures: Irrespective of the cause of any technical failure, no refund will be issued. CommfyCouch may, at its sole discretion, offer to reschedule the session. By booking a counselling session on CommfyCouch, the Client explicitly acknowledges and accepts that the session fee is non-refundable under all circumstances without exception. Rescheduling (Goodwill Basis) While refunds are not available for client cancellations, CommfyCouch may, at its sole discretion and as a goodwill gesture, allow you to reschedule your session to a future available slot, subject to the following conditions: β A rescheduling request must be submitted at least 24 hours before the originally scheduled session time by emailing support@commfycouch.com β Rescheduling is subject to counsellor availability and cannot be guaranteed β Each booking may be rescheduled once only β further cancellations or rescheduling requests for the same booking will not be entertained β Sessions rescheduled less than 24 hours before the original appointment, or after a missed session, will NOT be eligible for rescheduling. β Our Counsellor will only wait for a 15 minutes window after that the session will be treated as a no-show: No refund will be issued for no-shows No rescheduling will be offered for no-shows The full session fee is forfeited We encourage clients to contact us at support@commfycouch.com as soon as they know they cannot attend, even if it is within the 24-hour window, so we can make the best use of the counsellor's time. β Please note: Rescheduling is not a right but a goodwill accommodation. CommfyCouch reserves the right to decline rescheduling requests at its discretion. 5.4 Code of Conduct During Sessions You agree to engage in counselling sessions respectfully and in good faith. You agree NOT to: β Record sessions without the prior explicit written consent of your counsellor β Share session content, recordings, or notes on any public platform β Use abusive, threatening, or inappropriate language toward counsellors β Attend sessions under the influence of alcohol or controlled substances CommfyCouch reserves the right to terminate a session immediately and without refund if these conditions are violated. 5.5 Informed Consent Before your first counselling session, you will be required to complete an Informed Consent Form. This form outlines the nature of counselling, its limitations, confidentiality, and emergency procedures. No counselling session will be conducted without prior informed consent. 5.6 Crisis and Emergency Situations CommfyCouch counsellors are not equipped to handle psychiatric emergencies. If you disclose that you are in immediate danger, are experiencing suicidal ideation with intent, or pose a risk of harm to yourself or others, the counsellor may be obligated to involve emergency services or break confidentiality in accordance with professional ethics and Indian law. CommfyCouch shall not be liable for actions taken in good faith to prevent harm. 5.7 Minors Counselling services are available only to individuals aged 18 years and above. Persons under the age of 18 may access counselling only with the documented written consent of a parent or legal guardian, and the guardian must be involved in the intake process. Intellectual Property Rights All content on the CommfyCouch platform, including but not limited to website design, layout, graphics, journal designs, blog articles, worksheets, videos, audio content, logos, trademarks, and brand identity, is the exclusive intellectual property of CommfyCouch and is protected under: β The Copyright Act, 1957 (India) β The Trade Marks Act, 1999 (India) β Applicable international intellectual property conventions You may not copy, reproduce, distribute, publicly display, modify, translate, create derivative works from, or otherwise exploit any CommfyCouch content without our prior written permission. Sharing individual links to our website or citing our content with proper attribution is permitted for non-commercial purposes. Any feedback, suggestions, or ideas you submit to CommfyCouch may be used by us without restriction or compensation to you, and we shall not be obligated to keep them confidential. 7. Prohibited Uses By using CommfyCouch, you agree NOT to engage in any of the following: β Using the platform for any unlawful purpose or in violation of any applicable laws β Impersonating any person or entity, or misrepresenting your identity or affiliation β Attempting to gain unauthorised access to any part of the platform, other user accounts, or our servers β Uploading or transmitting viruses, malware, or any other harmful code β Using automated scripts, bots, or data-scraping tools to extract content from the platform β Harassing, threatening, or abusing CommfyCouch staff, counsellors, or other users β Posting false, misleading, or defamatory reviews or testimonials β Using CommfyCouch services to promote competing services or businesses without our written consent β Attempting to reverse engineer, decompile, or extract source code from any part of the platform β Violating any third party's privacy, intellectual property, or other rights through use of our platform CommfyCouch reserves the right to suspend or permanently ban any user found in violation of these prohibitions, without prior notice and without refund of any amounts paid. 8. Disclaimers and Limitation of Liability 9.1 Professional Disclaimer CommfyCouch's counselling services and digital products are intended for educational, wellness, and personal growth purposes. They are NOT a substitute for: β Psychiatric assessment or diagnosis β Medical treatment or prescription medication β Clinical psychological intervention β Emergency mental health services CommfyCouch does not guarantee any particular outcome from counselling sessions or use of digital products. Results vary between individuals based on personal circumstances, engagement, and other factors. 9.2 Warranty Disclaimer CommfyCouch provides the platform and all services "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that: β The platform will be uninterrupted, error-free, or secure at all times β Information on the platform is accurate, complete, or current β Any specific results will be achieved through counselling or use of our products CommfyCouch β Terms & Conditions | www.commfycouch.com | Page 4 9.3 Limitation of Liability To the fullest extent permitted by applicable Indian law, CommfyCouch, its owners, directors, employees, counsellors, and affiliates shall not be liable for: β Any direct, indirect, incidental, special, or consequential damages arising from your use of the platform or services β Loss of data, revenue, profits, goodwill, or other intangible losses β Any harm arising from reliance on content published on the platform β Any technical failures, delays, or service interruptions In any event, CommfyCouch's total liability to you for any claim shall not exceed the amount paid by you for the specific product or service giving rise to the claim. 9.4 Indemnification You agree to indemnify and hold harmless CommfyCouch, its owners, employees, and counsellors from any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from: (a) your violation of these Terms; (b) your use of the platform or services; (c) your violation of any third-party rights; or (d) any content you submit through the platform. 9. Third-Party Services, Payment Gateways, and Links 10.1 Payment Gateway Responsibility By making a payment on CommfyCouch, you agree and acknowledge the following: β The payment gateway (Razorpay / UPI Qr Code of Bank of Baroda) is solely and exclusively responsible for the processing, security, and completion of your transaction, regardless of the payment method used. β CommfyCouch is not responsible for any payment failures, declined transactions, duplicate charges, delays, errors, cyber attack and spamming arising from or within the payment gateway or your bank/card issuer. β CommfyCouch does not store, access, or have visibility into your payment credentials, card details, bank account numbers, UPI IDs, or any other financial information. All such data is handled directly by the respective payment gateway under their own security standards. β Any disputes, chargebacks, or issues relating to payment processing must be first raised with the respective payment gateway through their official dispute resolution mechanisms, in addition to notifying CommfyCouch at support@commfycouch.com. β CommfyCouch shall not be held liable for any financial loss, transaction errors, or data breaches that occur at the payment gateway level. The payment gateway's own terms of service and liability policies govern such matters. β CommfyCouch accepts no responsibility for currency conversion fees, international transaction charges, or additional fees levied by your bank or card network in connection with your payment. 10.2 Other Third-Party Services CommfyCouch may integrate or link to third-party services including video conferencing platforms, email service providers, and social media platforms. These third parties have their own terms of service and privacy policies, which we encourage you to review. CommfyCouch is not responsible for the content, privacy practices, or actions of any third-party service providers. The inclusion of a link or integration does not constitute an endorsement by CommfyCouch. 10. Privacy Your use of CommfyCouch is also governed by our Privacy Policy, which is incorporated by reference into these Terms. By using our platform, you consent to the collection, use, and processing of your personal data as described in our Privacy Policy. Modifications to Services and Terms CommfyCouch β Terms & Conditions | www.commfycouch.com | Page 5 CommfyCouch reserves the right to: β Modify, suspend, or discontinue any service or feature at any time without prior notice β Change prices for counselling sessions or digital products at any time (price changes will not affect existing confirmed bookings or completed purchases) β Update these Terms at any time by posting a revised version on our website It is your responsibility to check these Terms periodically. Your continued use of CommfyCouch after any modifications constitutes your acceptance of the changes. 12. Termination Either party may terminate the user relationship at any time: β You may stop using CommfyCouch at any time and may request account deletion by emailing support@commfycouch.com β CommfyCouch may immediately terminate or suspend your access, without notice or refund, if you breach any of these Terms, engage in fraudulent activity, or pose a risk to other users or the platform Upon termination, your licence to use CommfyCouch content and services ceases immediately. Sections relating to intellectual property, disclaimers, limitation of liability, and governing law shall survive termination. 13. Governing Law and Dispute Resolution 14.1 Governing Law These Terms shall be governed by and construed in accordance with the laws of India, including but not limited to the Information Technology Act 2000, Consumer Protection Act 2019, Copyright Act 1957, and the Digital Personal Data Protection Act 2023. 14.2 Jurisdiction Any disputes arising from these Terms or your use of CommfyCouch shall be subject to the exclusive jurisdiction of the courts located in Jodhpur, Rajasthan, India. By using CommfyCouch's services, you irrevocably submit to the personal jurisdiction of such courts and waive any objection to such jurisdiction or venue. No dispute shall be transferred to any other court or jurisdiction under any circumstances. 14.3 Dispute Resolution Process In the event of any dispute or grievance, we encourage you to first contact us at support@commfycouch.com. We will make good-faith efforts to resolve disputes within 30 days. If the matter is not resolved, either party may pursue resolution through appropriate legal channels as described above. 14. General Provisions Entire Agreement: These Terms, together with our Privacy Policy and Refund Policy, constitute the entire agreement between you and CommfyCouch regarding your use of the platform and services. Waiver: Failure by CommfyCouch to enforce any provision of these Terms shall not constitute a waiver of our right to enforce that provision in the future. Assignment: You may not assign or transfer your rights or obligations under these Terms without CommfyCouch's prior written consent. CommfyCouch may assign its rights and obligations in the event of an internal restructuring; however, NO personal data, counselling session records, client information, or any user data of any kind shall be transferred to any third party, acquiring entity, or successor organisation under any circumstances, including in the event of a merger, acquisition, sale of assets, or business transfer. In such events, all personal data shall be permanently and securely deleted prior to any transaction being completed. Force Majeure: CommfyCouch shall not be liable for any failure to perform its obligations due to circumstances beyond our reasonable control, including natural disasters, government actions, internet outages, pandemics, or other force majeure events. Language: These Terms are written in English. In the event of any conflict between an English version and any translated version, the English version shall prevail. Electronic Communications: By using CommfyCouch, you consent to receive communications from us electronically (via email or website notices), and you agree that such electronic communications satisfy any legal requirement for written communication.
